Terms of Service

1. The Service

HomeDesignly provides AI tools that create interior, exterior, landscape and floor plan designs, images and videos from the photos and descriptions you provide.

Results are AI-generated visualizations for inspiration and planning. They may be inaccurate and are not professional architectural, engineering, construction or real-estate advice. Floor plans are concepts and are not to scale. Consult qualified professionals and follow local building codes before you build, renovate, buy or sell.

2. Your account

You must be at least 18 years old to create an account or make a purchase. Give us accurate information, keep access to your email account secure, and tell us at contact@homedesignly.app if you think someone else has used your account. You are responsible for activity on your account.

3. Credits and subscriptions

Creating designs uses credits. The cost is shown before you start and depends on the tool, the model (Lite or Max) and, for videos, the length.

• Subscriptions renew automatically every month or year until you cancel. You can cancel at any time on the Billing page; your plan stays active until the end of the period you have paid for, and there are no prorated refunds for partial periods.
• Subscription credits are added at the start of each billing period and expire when the subscription period they were granted for ends.
• Credit packs are one-off purchases, and their credits never expire while your account is open.
• Upgrades take effect immediately, and you pay the prorated difference. Downgrades take effect at the end of the current billing period.
• If a design fails to generate, the credits it used are returned to your balance automatically.
• Credits have no cash value and cannot be transferred or sold. Bonus and free credits (such as sign-up or promotional credits) have no cash value and are never refunded. Credits end when your account is deleted.
• Payments are processed by our payment processor. Prices are shown before checkout and may exclude taxes. We may change prices; a new price applies to an existing subscription only from the renewal after we notify you.

4. Refunds

Credits that have been used are not refundable. Otherwise:

• A credit pack, or the first payment of a subscription, can be refunded within 14 days of purchase if none of the credits it added have been used.
• Subscription renewals and partial billing periods are not refunded; cancel before the renewal date to avoid the next charge.
• To request a refund, email contact@homedesignly.app from the address on your account with the date of the purchase. Approved refunds go back to the original payment method, and the credits from that purchase are removed.
• Nothing in these Terms limits a refund you are entitled to under the law where you live.

5. Consumers in the EU and UK

Credits are digital content supplied immediately. When you buy credits, you ask us to make them available right away and acknowledge that you lose your 14-day right of withdrawal once you start using them. Until you use any of the credits from a purchase, you can withdraw within 14 days of buying them for a full refund by emailing contact@homedesignly.app.

6. Chargebacks and disputes

If you dispute a payment with your bank or card issuer, or a payment is reversed, we may remove the credits that payment added, including any bonus that came with it, and may suspend the account while the dispute is open. Please contact us first; most problems can be solved faster by email.

7. Your content

You keep all rights to the photos and other content you upload. You give us a limited, non-exclusive license to store, process and display that content, and to send it to our AI providers, only to operate the Service for you. The license ends when you delete the content or your account, except for copies we must keep by law.

You confirm that you have the right to upload each photo, for example because you took it, own the property or have the owner's permission, and that doing so does not violate anyone else's rights, including the privacy of people shown in it.

8. Your results

As between you and us, you own the images and videos you create and may use them for any lawful purpose, including commercial uses such as property listings, client presentations and marketing, subject to the terms of the AI providers that produced them. Because AI can produce similar results for different users, we cannot promise that your results are unique or that they are protected by copyright.

If you use virtually staged or edited photos to market a property, label them as required by law and by the listing platform, and do not use them to misrepresent the property's actual condition.

9. Acceptable use

You agree not to:

• upload photos of other people's property or other content you do not have the right to use;
• upload or create content that is illegal, sexually explicit, hateful, violent or harassing, that sexualizes minors, or that shows identifiable people without their consent;
• use results to deceive buyers, renters or others about a real property;
• get around credit, rate or security limits, share accounts, or access the Service with bots or scrapers without our permission;
• copy, resell or reverse engineer the Service, or interfere with its operation.

10. Suspension and termination

You can stop using the Service and delete your account at any time from your Profile page. We may suspend or close an account that breaks these Terms, is used for fraud or puts the Service or other users at risk. If we close an account for these reasons, unused credits are forfeited and paid fees are not refunded, unless the law requires otherwise.

11. Third-party services

Some features rely on third parties, such as our payment processor, Sign in with Google and the third-party AI model providers that create your designs. Your use of those features is also subject to their terms and privacy policies.

12. Changes to the Service

We are continually improving the Service and may add, change or remove features, tools and AI models. If we stop offering the Service entirely, we will tell you in advance and refund the unused part of any prepaid subscription.

13. Disclaimers

The Service and all results are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. Some jurisdictions do not allow these exclusions, so some may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, NEOLOGY LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.

15. Indemnity

You agree to defend and compensate NEOLOGY LLC for claims, losses and costs (including reasonable legal fees) arising from your content, your use of results, or your breach of these Terms, to the extent permitted by law.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there.

17. Changes to these Terms

We may update these Terms. We will change the date at the top and, for significant changes, tell you by email or in the Service before they take effect. If you keep using the Service after that, the updated Terms apply; if you do not agree, you can delete your account.

18. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
